NOTICE OF VACANCY IN OFFICE OF TOWN COUNCILLOR
NOTICE IS HEREBY GIVEN pursuant to Section 87 (2) of the Local Government Act 1972 that vacancies exist in the office of Town Councillor for the following
Stakesby Ward in the Parish of Whitby – 2 vacancies
Town North Ward in the Parish of Whitby – 2 vacancies
Town South Ward in the Parish of Whitby – 1 vacancy
West Cliff Ward in the Parish of Whitby – 1 vacancy
The Town Council is required to try and fill these vacancies by co-option within 35 days.
Any Elector (over 18) interested in applying for co-option as a Town Councillor should contact the Town Clerk for details of the Town Council’s Co-option Policy and Application Form.
Completed applications to be returned to the Town Clerk no later than 12 noon on the 31st May 2011.

WTC has provided the (at present) 13 Councillors with a *CONFIDENTIAL* list of the ELEVEN Applicants – seven of whom were accepted AFTER the dead-line – because the Clerk’s Office was CLOSED ALL DAY on dead-line day. Apparently, the list, released on those infamous ‘pink papers’ (denoting ‘Strictly Confidential’) cannot be disclosed to the general public. Perhaps they think the public have no right to know who has volunteered to represent them? Here’s the ‘SECRET’ list, in alphabetical order:

Ah yes, the word ‘SECRET’ crops up yet again, a word synonymous with SBC and, apparently, with WTC too.

The Deputy Clerk, unable to fathom the straightforward Co-Option Policy document adopted by WTC on 5th April 2011 (in anticipation of a paucity of Candidates for Election), has sought advice (yes – with a ‘c’) from Sue Bedford, who sought advise (yes, with an ‘s’) from Ian Anderson, who consulted the Representation of the People Act 1985 and discovered that there is no legislation to cover the consequences of the blind leading the blind:

Anne,
Further to your enquiry yesterday I have checked on the legislation and taken advise from Ian Anderson. Attached is a copy of an extract from the representation of the people act 1985 – Section 21 refers.
If you do not co-opt by 24th June 2011 the town Council could, if they wish, request the Borough Council to call an election under S39. Howevere, S39 is clearly aimed at circumstances where there are difficulties with an election, rather the norm.
It provides a power not a duty, to call an election where there are “difficulties” with the election. We would need to be persuaded that there were “difficulties” that merited the calling of an election so soon after the Borough wide election.
I hope the above is of assistance to you.
No doubt you will keep me advised of progress or otherwise.
