I have had passed to myself 2 letters regarding alleged illegal content on my website www.real-whitby.co.uk. The letters are from Lisa Dixon Head Of Legal services and I would appreciate it if you could forward this email to her as her email address is not on the letter.
Real Whitby operates a policy of retrospective moderation on articles and comments, and whilst we are happy to hear from you we are also shocked that this is your first ever contact with ourselves regarding the site. Given that you are suggesting “many of the articles and comments published amount to actionable breaches of civil law” I would have expected you to make contact about specific incidents as and when they occurred. At which point we would have been only too happy to offer as much help as possible.
To ask at this point in time for us to remove every mention of Scarborough Borough Council from our website is simply not possible. Our website currently has some 1300 published articles and some 6300 comments which are read by a monthly readership of around 22,000 unique individual people. As our governing council many of the articles relate in some way to Scarborough Borough Council, Some of the articles are written by various contributors to the site and some are your own press releases.
Other than to shut the site down there is no way I can guarantee every mention of the council is removed, and shutting the site down is not something Im willing to do as it is part of my business and provides part of my income.
Your letter is very non specific in its demands. I am more than happy to work with you if you can identify very specific pieces of information you consider to be in breach of criminal or civil law. It is not my intention to run an illegal business and I certainly do not wish for this to end up in a courtroom, however for me to be able to offer assistance you must be specific about articles and comments you want removing.
