  • Real Whitby is happy to comply with a request to publish the complete correspondence record between a member of the public and Mr Chris Adnitt, Clerk to Folkton Parish Council. (Mr Chris Adnitt is also the Responsible Financial Officer for Folkton Parish Council – isn’t that the Council whose Chairman’s company was fined £57,000 for illegal refuse-disposal!). It makes for an amusing read. That said, it is a perfect example of the arrogance and stupidity one encounters in local government throughout North Yorkshire. Enjoy!

That is what I am asking you for.

The Parish Council is trying to get hold of the “Declarations of Interests” forms for Folkton Parish Councillors from you, either in electronic format, or a link to the SBC website so that we can display them on Folkton Parish Council’s website in order to comply with statutory requirements.

The forms were complete in hard copy and sent to SBC at your request.

You can view the Parish Council’s website by goggleing “Folkton Parish Council”.

Are you able to assist with this please?

We need to go back to the beginning on this. I refer you to Lisa’s letter [LD/GW/3/37/17] of 23rd May 2012, in which she informed all the Parish Clerks about the requirement under the Localism Act 2011 (in force as of 1st July 2012) to update the RoIs for display on the Council website(s). Obviously, they should have been available on-line for some time now. The problem is that I cannot seem locate them. It would be helpful to know when and how they were sent in to the Town Hall, and for whose attention. I take it that you have not retained digital copies? Also, are your Standing Orders available yet for online publication?

Dear Parish Clerk,

Unfortunately, not only am I unable to locate your Registers of Interest – documents the safe-keeping of which you and you alone bear the burden of responsibility – I am also unable to locate any record of receipt of said documents.

Clearly, if the Registers of Interest are not to be located it becomes urgently necessary to prepare new ones, since it will be impossible to comply with the terms of the Localism Act 2011, requiring the publication on the Council’s web-site of all members’ Registers of Interests – the responsibility for which also resides with you. The Localism Act 2011 came into force on 1st July 2012. The absence of the Registers of Interests on the web-site leaves the Council susceptible to sanction.

Regarding the present Standing Orders of Folkton Parish Council, I expect that you do have a copy in your safe-keeping. If you could arrange to visit your local Library, I believe you will find that the staff will assist you in preparing inexpensive digital scans of the documents so that you can bring the Council up to date with the statutory requirements.

Finally, if I might ask you to moderate your tone and phraseology, please. We all have a job to do and it is not facilitated by bursts of indignant irritation and petulant recriminations. Thank you.

I regret to read that you appear to be unwilling to adhere to the statutory requirement to display the Registers of Interests of your Members on the Council’s web-site.

I find it extraordinary that there would appear to be no record of receipt of your Members’ Registers of Interests.

Irrespective of with whom the blame may lie in regard to their absence from the public record, I can only repeat that, as Clerk to Folkton Parish Council, it is with you and you alone that the statutory duty lies to ensure that Declarations are made by your Members, and that an up-to-date Register of Interests for each Member of your Council is available on the web-site for public scrutiny.

It is regrettable that you are labouring without the benefit of the necessary technological tools. That, however, is something you must take up with your Members, who will need to consider the urgent necessity to allocate funding to provide you with suitable equipment and training – without which you will continue in breach of the requirements of the Localism Act 2011. Your Members will be aware that certain breaches of the Act may constitute criminal offences.

Regarding the more straightforward issue of the Standing Orders, please make it your business to visit Eastfield Library, where facilities are available for you to scan the document, save it in PDF format, and attach it to an email to me at your very earliest convenience.

As to your question regarding who I think I am, I can only answer you thus:

I am the person who is patiently attempting to ensure that your Council is compliant with the law. Secretary of State for Communities & Local Government, the Rt.Hon. Erick Pickles, has written to all of the County and District/City/Borough Councils, emphasizing the imperative to ensure that Councils operate with transparency and accountability to the public.

I am satisfied that I have conducted myself correctly in my correspondence with you. If you would like me to attend your next meeting to explain these matters to your Chair and Members, I will be happy to do so.

On 3 October, I emailed you asking to see your Members’ Registers of Interests, as is my right as a member of the public. For 27 days now you have evaded my every attempt to persuade you to make them available to me.

On 10 October, I made clear to you the fact that you appeared to have allowed yourself to become confused. I hoped that you would be able to direct me to the party at the Town Hall to whom, you asserted, you had sent the documents, so that I might pursue sight of them there, not wishing to tax you further.

I them allowed a hiatus of almost two weeks to elapse before reminding you, on 25 October, of your statutory obligation to provide the specified documents.

On 26 October, you responded to the effect that the Registers had already been sent to me. You instructed me to set about finding them. Having never received them, I responded by asking you to send them again. You followed with the non sequitur that you had no photocopying facilities. Your response was rather rude.

On 29 October, I patiently explained your obligation to make the documents available.

Your response was not only (once again) evasive, but openly rude: (I quote) “Just who do you think you are?”, followed by your demand for my apology. You have been overlooking the nature of our relationship, Mr Clerk – you are a public servant and I am a member of that public.

Notwithstanding the offensive tone and content of your email, I responded to you by once again patiently explaining your precarious position in relation to your statutory duty; I quote:

“I am the person who is patiently attempting to ensure that your Council is compliant with the law. Secretary of State for Communities & Local Government, the Rt.Hon. Eric Pickles, has written to all of the County and District/City/Borough Councils, emphasizing the imperative to ensure that Councils operate with transparency and accountability to the public.”

You have now come back to me with your most offensive email to date, though I see no grounds for you to take issue with my attempt to clarify your position.

I cannot begin to imagine what possessed you of the notion that you could make a complaint to Scarborough Borough Council against a member of the public, divulging the identity and personal contact details of that member of the public, who had been patiently attempting to exercise the right of all members of the public to view the Registers of Interests of your Members and the Standing Orders of your Council, only to be met by an obstinate refusal to comply with the law, couched in your most offensive tone of language yet.

Scarborough Borough Council has no jurisdiction over my request for information that, by law, should already be in the public domain. However, it may be that the Monitoring Officer of Scarborough Borough Council does have the duty to consider, with the Independent Person, complaints against Parish Clerks. It may be that breaches of the terms of the Localism Act 2011 must be referred to the police.

How you have now arrived at your faulty conjecture that I am employed by Scarborough Borough Council or North Yorkshire County Council remains completely unclear to me.

So I would respectfully suggest that you provide me with e-format copies of your Members’ Registers of Interests, together with an e-format copy of your Council’s Standing Orders just as soon as you are able to overcome your disadvantages. Shall we say, not later than Friday 8 November? I would expect to see those documents displayed on the Parish Council web-site at the same time; indeed, I am happy to download them from there to spare you the inconvenience of attaching them to an email to me.

Either of the foregoing resolutions would spare the public purse the expense of a Formal Complaint, with its concomitant officer time and sundry other costs, to say nothing of relieving the Monitoring Officer of yet another problem that should never have arisen.

I await your full compliance with the law.

    @ Carole: According to the Folkton Parish notices, the next meeting of the Parish Council will take place on 7 January 2013. Seemingly, what this Parish Council does for the residents is to lock them into a Groundhog Day style time-loop. 2013 for ever!
